TERMS OF SERVICE
1. INTRODUCTION
These Terms of Service govern your use of services provided by Debora Garcia Makeup through our Shopify store at www.makeupbydgarcia.myshopify.com.
By accessing or using our services, you agree to be bound by these Terms.
2. SERVICES OFFERED
We provide the following services:
- Bridal makeup application
- Special event makeup application
- Makeup services for wedding parties including bridesmaids and flower girls
- In-person shopping assistance and product recommendations
- Online makeup consultations
- Makeup Group Events
- Travel to customers locations within Greater London.
3.1 Booking Requests
All service bookings must be made through our Website or by direct contact via the methods provided on our Website. Bookings are subject to availability and confirmation.
3.2 Booking Confirmation
Your booking is not confirmed until:
- You have received a booking confirmation from us
- The required deposit has been paid
- The date and time have been mutually agreed upon
4. PRICING AND PAYMENT
4.1 Pricing
All prices are listed in Pounds Sterling (GBP) and are inclusive of VAT (where applicable). Prices are subject to change, but any price changes will not affect bookings that have already been confirmed.
4.2 Deposits
A non-refundable deposit of 30% of the total service cost is required to secure your booking. This deposit will be deducted from the final amount due.
4.3 Final Payment
The remaining balance must be paid 14 days before the scheduled service date (for bridal makeup service and group events) or in the moment of the booking (for other services), as specified in your booking confirmation.
4.4 Payment Methods
We accept payment via Paypal or Bank transfer, as available through our Website.
5. CANCELLATION AND RESCHEDULING POLICY
5.1 Cancellation by Client
- Cancellations made 30 or more days before the scheduled service date: The deposit is non-refundable, but may be transferred to a new booking within 6 months.
- Cancellations made less than 14 days before the scheduled service date: The full service fee is payable.
- Cancellations made 14-29 days before the scheduled service date: deposit remains non-refundable and 75% of the remaining balance is due.
5.2 Rescheduling by Client
Rescheduling requests must be made at least 48 hours before the scheduled service date. Rescheduling is subject to availability and may incur an additional fee of 10% of the total booking balance.
5.3 Cancellation by Us
In the rare event that we need to cancel your booking, we will:
- Provide as much notice as possible
- Offer to reschedule for the next available date
- Provide a full refund of any payments made if rescheduling is not possible or not desired
6. TRAVEL POLICY
6.1 Travel Fees
Travel fees may apply for services provided outside of zone 4. Travel fees are calculated based on distance and time and will be clearly communicated before booking confirmation.
6.2 Travel Limitations
We reserve the right to decline bookings that require travel beyond Zone 5.
7. ONLINE CONSULTATIONS
7.1 Technical Requirements
You are responsible for ensuring you have:
- A stable internet connection
- A device with a functional camera and microphone
- Any requested makeup items or tools for the consultation
7.2 Consultation Recording
Online consultations may be recorded with your explicit permission for training and quality assurance purposes. You will be notified before any recording begins.
8. HEALTH AND SAFETY
8.1 Health Information
You must inform us of any allergies, skin conditions, or other health concerns that may affect the makeup application. We reserve the right to refuse service if we believe it may adversely affect your health or safety.
8.2 Hygiene Standards
We maintain high standards of hygiene, including sanitising all tools and products between clients. You may be asked to cleanse your face before makeup application.
9. INTELLECTUAL PROPERTY AND PRIVACY
9.1 Before and After Images & Video
We may request permission to take before and after photographs and video of our work for our portfolio, social media, and marketing materials. Your written consent will be obtained separately for this purpose.
9.2 Privacy Policy
Our collection and use of your personal information are governed by our Privacy Policy, which is available on our Website.
10. LIABILITY LIMITATION
10.1 Service Outcomes
While we strive for excellence in all our services, we cannot guarantee specific outcomes. Makeup application is subjective, and final results may vary based on individual skin types, conditions, and preferences.
10.2 Limitation of Liability
Our liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.
10.3 Personal Property
We are not responsible for loss or damage to personal property during the provision of our services.
11. CONSUMER RIGHTS
Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015.
12. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of England and Wales Jurisdiction. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England.
13. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. Changes will be posted on our Website and will be effective immediately upon posting. Your continued use of our services after changes constitutes your acceptance of the revised Terms.
